The Firm's Environmental Law Practice Area represents companies, financial institutions, commercial developers, municipalities, property owners and individuals on a variety of environmental, land use and worker safety matters. Lawyers assist clients in administrative and litigation proceedings, due diligence investigations, permitting, remediation projects, local and state land use matters and employer/employee safety issues.
Litigation and Administrative Proceedings
Lawyers in this Practice Area represents clients in Litigation and administrative proceedings on environmental and land use issues before local, state, and federal administrative agencies and state and federal courts. They assist clients in responding to enforcement actions initiated by regulatory agencies, including actions involving Superfund, RCRA, TSCA and the Clean Water and Air Acts and their state counterparts. They are also involved in private litigation representing businesses, property owners, lenders, estates, individuals and others in a variety of environmental land use matters. The lawyers in this area have acted as mediators and arbitrators in state and national environmental dispute resolution proceedings.
Real Estate and Business Transactions
Lawyers in this area devote significant attention to advising clients on the environmental implications of real estate and business transactions, including the acquisition and sale of businesses and real estate, corporate financing, bankruptcies and workouts. They assist clients by identifying and addressing environmental concerns, including issues relating to the Connecticut Transfer Act, permitting, remediation and environmental compliance, and developing sound solutions to limit potential liabilities and allocate environmental risks. It works with clients to explore opportunities available under state and federal Brownfields Programs, state funding mechanisms for developing contaminated real estate, and environmental insurance. In addition, the lawyers counsel borrowers and financial institutions with respect to their potential environmental liabilities in loans secured by real estate or assets and loan workouts.
Remediation Projects
Our Environmental lawyers work with clients and environmental engineers on environmental remediation projects resulting from voluntary, litigation or enforcement decisions. They advise clients on cost effective remedial options available under state and federal clean-up standards and then secures approvals, permits, contracts and other requirements to implement the project. The lawyers have also worked on a variety of solid and hazardous waste projects including sites impacted by petroleum, solvents, metals, mercury, pesticides, PCBs and, radioactive materials.
Land Use, Wetlands and Coastal Matters
We assist businesses, developers and individuals in securing local, state and federal approvals and permits necessary for the operation of their business or development of their property. Our lawyers represent clients before planning and zoning, wetlands, coastal commissions, the Connecticut Siting Council and other land use organizations. We also prepare and submit permit applications and cooperatively works with environmental and civil engineers, soil scientists and other professionals on a variety of new development, "smart growth", and Brownfield projects.
Employee Health and Safety; Personal Planning
The Environmental attorneys work with other Practice Areas within the Firm including the Labor and Employment Practice Area on employer/employee safety and OSHA issues and the Estate Planning Practice Area on personal, family and fiduciary planning matters requiring inheritance, ownership or management of contaminated assets and to assists individuals to overcome or minimize environmental impediments.
